These Terms & Conditions ("Terms") govern your access to and use of Playbook Refinery (the "Service"), an AI-powered trading journal provided by Pierson Hosie("Pierson Hosie", "we", "us", or "our"). By creating an account, accessing, or continuing to use the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & Authority

You must be of legal age to form a binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. You agree to provide accurate information and keep it up to date, and you are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2. The Service

Playbook Refinery lets you upload chart screenshots and notes and uses artificial intelligence to grade trades, generate journal entries, detect potential mistakes, and track your performance over time. We grant you a limited, non-exclusive, non-transferable right to use the Service within the limits of your selected plan.

3. Acceptable Use & Restrictions

You agree not to misuse the Service. In particular, you must not:

• use the Service for any unlawful, fraudulent, or deceptive purpose;
• send spam or infringe the intellectual property or other rights of others;
• interfere with or compromise the security of the Service, including by introducing malware, probing or scanning, or scraping data;
• reverse engineer, decompile, or attempt to derive source code;
• resell, redistribute, or sublicense the Service;
• circumvent usage limits, access controls, or technical restrictions.

4. AI Outputs & Your Responsibilities

The Service uses generative AI. You are responsible for the prompts and content you submit, for how you use the outputs, for verifying the accuracy of outputs, and for ensuring you have the rights to any content you input. You must not use the Service to generate illegal content, deepfakes, hate speech, malware, or to attempt to jailbreak or bypass safety controls.

We may, at our discretion, remove or restrict content, refuse or filter outputs, and suspend accounts to enforce these Terms. If you believe an output infringes your rights, contact us so we can review and, where appropriate, take down the relevant content; repeated infringement may result in account termination.

5. No Financial Advice

Playbook Refinery is a journaling and analysis tool. All grades, scores, insights, and other outputs are provided for general and educational purposes only. They are not financial, investment, legal, or tax advice, and are not a recommendation to buy, sell, or hold any asset. Trading involves substantial risk. All trading and investment decisions are your own responsibility, and you should consult a qualified professional before acting.

6. Intellectual Property

Pierson Hosie retains all ownership of the Service and its intellectual property, including software, documentation, and branding. You retain ownership of the content you submit and grant us a limited license to host and process that content solely to provide the Service.

7. Payments & Subscriptions

Subscriptions are billed on a recurring basis according to the plan you select. Payment, billing, taxes, currency, cancellation, and refund mechanics are handled by our reseller and are subject to Paddle's Buyer Terms. See our Refund Policy for refund details.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

8. Service Availability & Warranties

We work to keep the Service available but do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Limitation of Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid in the 12 months before the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is not permitted by law.

10. Indemnity

You agree to indemnify Pierson Hosie against claims arising from your content, your unlawful use of the Service, or your violation of these Terms.

11. Suspension & Termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends; we will provide a reasonable window to export your data where feasible before deletion.

12. Changes, Governing Law & Contact

We may update these Terms from time to time; continued use after changes take effect constitutes acceptance. These Terms are governed by the laws of the jurisdiction in which Pierson Hosie is established. Questions about these Terms can be sent to our support team.
